Terms & Conditions

Introduction

These Terms and Conditions ("Terms") govern your use of the Workpermitter service provided by Tarmack ("Company", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.

Services

Workpermitter assists in sponsoring work permits/visas and acts as the Employer of Record (EOR) for foreign nationals. We employ individuals through our legal entities in numerous countries around the world and deputize them to the ultimate employer.

Job Seeker Responsibilities

  • Accurate Information:

    You agree to provide accurate and complete information during the application process and notify us promptly of any changes.
  • Compliance:

    You must comply with all relevant laws and regulations of the country in which you seek employment.
  • Job Search:

    You are responsible for identifying and securing a job with an ultimate employer. We do not guarantee employment ourselves.
  • Documentation:

    You must provide all necessary documentation and cooperate fully during the visa application process.

Employer Responsibilities

  • Payment Agreement:

    The ultimate employer agrees to pay the salary to Workpermitter, which will then be paid to the employee.
  • Coordination:

    Employers must cooperate with Workpermitter to facilitate the employment and visa sponsorship process.
  • Compliance:

    Employers must comply with all relevant laws and regulations, including but not limited to labor laws, tax regulations, and workplace safety standards.

Fees and Payments

  • Service Fees:

    Applicable fees for our services will be outlined in the agreement and are subject to change with notice.
  • Payment Terms:

    All payments must be made in accordance with the payment terms specified in the agreement. Late payments may incur additional fees or interest.
  • Refund Policy:

    Fees paid are generally non-refundable, except under any specific conditions explicitly outlined in the agreement.

Termination

  • For Cause:

    We may terminate the agreement if you or the employer breach any of these Terms, including failure to comply with legal requirements or payment obligations.
  • Without Cause:

    Either party may terminate the agreement with written notice as specified in the agreement. Termination without cause may be subject to a notice period and additional terms as outlined in the agreement.
  • Effect of Termination:

    Upon termination, you must cease using our services, and any outstanding obligations must be settled.

Limitation of Liability

  • No Warranty:

    Our services are provided "as is" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • Liability Cap:

    We are not liable for any indirect, incidental, special, consequential, or punitive damages.

No Job Guarantee

  • Disclaimer:

    We do not guarantee that you will secure employment. Our role is to sponsor the work permit/visa and act as the Employer of Record once you have secured a job. You must actively seek and secure employment independently.

Governing Law

These Terms are governed by and construed in accordance with the laws of United States. Any disputes arising from these Terms or your use of our services will be subject to the exclusive jurisdiction of the courts in that jurisdiction.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on our website. Continued use of our services after any changes constitutes acceptance of the new Terms.
